Nous proposons la tarification la mieux adaptée à chaque type de manifestation ou d'activité à caractère sportif comportant la participation de véhicules terrestres à moteur. Nous concluons des accords d'acceptations et de rétrocessions en réassurance.

Un décret n°2006-554 du 16 mai 2006 actualise les dispositions relatives aux concentrations et manifestations organisées sur la voie publique ou dans des lieux non ouverts à la circulation publique et comportant la partricipation de véhicules terrestres à moteur.

Sont abrogés, pour les épreuves et compétitions de véhicules terrestres à moteurs, les décrets n°55-1366 du 18 octobre 1955 et n°58-1430 du 23 décembre 1958. L'article 11 du décret n°2006-554 du 16 mai 2006 stipule :

"Toute concentration ou manifestation ne peut débuter qu'après production à l'autorité administrative compétente ou à son représentant d'une police d�assurance souscrite par l'organisateur auprès d'une ou de plusieurs sociétés agréées en France, dans un autre Etat membre de la Communauté européenne ou dans un autre Etat partie à l'accord sur l'Espace économique européen.

La police d'assurance garantissant la manifestation et ses essais couvre la responsabilité civile de l'organisateur et des participants ainsi que celle de toutes personne qui prête son concours à l'organisation avec l'accord de l'organisateur. La police garantissant la concentration n'est pas tenue de couvrir la responsabilité civile des participants.

Un arrêté conjoint du ministre chargé de l'économie et du ministre chargé des sports détermine le montant minimum des garanties couvrant respectivement les dommages corporels et les dommages matériels."

If the gathering or event to be insured is to take place entirely on a permanent course or one specially set up for the circumstance and closed to public traffic, attach to the proposal a large-scale plan of the course, indicating:

1°) The layout of the track, its width, nature of the surfacing, access routes and clearance routes reserve ed for spectators and those reserved for the security service;

2°) Placement of the stands with their distance from the track, the nature of their construction, their capacity, places reserved for the public aside from the stands, with their distance from the track, prohibited spaces, the nature of any permanent or special installations to protect the public (crash barriers, wire fencing, mounds of earth, walls, etc...) ;

3°) Placement of all fixed installations: bars, restaurants, etc... ; placement of refuelling stations, security service (firefighters, health service), the spectators’ parking lot and the competitors’ lot.

If the gathering or event is to take place entirely on the road with trials involving private use of a public right-of-way, attach to the proposal a plan of that portion of the road on which the accessory trial will be held, mentioning:

The layout of the reserved road, its width, the nature of its surfacing, places reserved for the public and their distance from the road, prohibited spaces, existing natural protections, special protective installations that will be installed. If the plan described above has already be submitted to the insurers, attach to the proposal only a note specifying the modifications made in the security area since the last gathering or event of the same kind was held.

IN THE EVENT OF OMISSION, INACCURACY OR FALSE STATEMENTS, THE ANSWERS TO THIS PROPOSAL/QUESTIONNAIRE ARE SUBJECT TO THE SANCTIONS ESTABLISHED BY ARTICLES L 113 8 AND L 113 9 OF THE INSURANCE CODE.

The undersigned may ask the Company to notify it of and correct any information concerning it appearing in any file used by the Company, its agents, reinsurers and professional bodies
